Shipping and Delivery Policy (B2B Only)

EXW Germany or Netherlands – Incoterms® 2020

1. Business Customers Only

CC Corrosion Control Ltd. supplies products exclusively to business customers (B2B).

By purchasing products from us, the purchaser confirms that it is acting in the course of its commercial, industrial, trade or professional activities and not as a consumer.

Consumer protection provisions applicable exclusively to consumers, including statutory EU consumer withdrawal rights, do not apply.

2. Delivery Terms – EXW

Unless expressly agreed otherwise in writing, all products are supplied:

EXW (Ex Works) from the warehouse specified by CC Corrosion Control Ltd. in Germany or the Netherlands – Incoterms® 2020.

The applicable EXW location will be stated in the relevant quotation, order confirmation, invoice or other commercial documentation.

Delivery takes place when the goods are placed at the purchaser's disposal at the agreed EXW location.

3. Transport Arrangements and Costs

Unless expressly agreed otherwise in writing, the purchaser is responsible for arranging collection and onward transportation of the goods from the agreed EXW location.

The purchaser bears all costs associated with collection and onward transportation, including where applicable:

freight and transportation costs;
transport insurance;
Dangerous Goods surcharges;
customs duties and import charges;
taxes arising from importation;
transit charges; and
other costs associated with transportation to the final destination.

If CC Corrosion Control Ltd. assists the purchaser with obtaining freight quotations, communicating with carriers or arranging transportation on the purchaser's behalf, such assistance does not change the agreed EXW delivery term unless expressly agreed otherwise in writing.

Any transportation costs incurred on behalf of the purchaser may be charged separately.

4. Collection and Carriers

The purchaser is responsible for ensuring that the carrier selected for collection is appropriately qualified and authorized for the products being transported.

Where products are classified as Dangerous Goods, the purchaser must ensure that the carrier and transportation arrangements comply with all applicable Dangerous Goods regulations.

The purchaser must provide all information reasonably required for collection and transportation, including:

carrier details;
collection information;
destination details;
consignee contact details; and
any special delivery or regulatory information applicable to the destination.

CC Corrosion Control Ltd. and/or its logistics provider will provide the documentation legally required from the seller in connection with the goods and will reasonably assist with transport documentation where applicable.

5. Dangerous Goods

Certain products supplied by CC Corrosion Control Ltd. may be classified as Dangerous Goods.

Depending on the product, mode of transport and destination, requirements under ADR, RID, IMDG, IATA and/or applicable national Dangerous Goods legislation may apply.

The purchaser is responsible for ensuring that transportation arranged by or on behalf of the purchaser complies with all applicable requirements following delivery under the agreed EXW term.

The purchaser must also ensure that the destination is legally and operationally capable of receiving, storing and handling the relevant products.

6. Risk

Risk of loss of or damage to the goods passes to the purchaser in accordance with the agreed EXW Incoterms® 2020delivery term.

Unless expressly agreed otherwise, CC Corrosion Control Ltd. is not responsible for loss, damage, delay or additional costs occurring during transportation after delivery has taken place under the applicable EXW term.

Nothing in this provision excludes or limits liability that cannot legally be excluded or limited.

7. Availability and Collection

Any indicated availability, collection or delivery dates are estimates unless expressly confirmed as binding in writing.

The purchaser shall arrange collection within the agreed collection period.

If collection is delayed for reasons attributable to the purchaser, additional storage, handling or other costs may be charged to the purchaser.

8. Cross-Border Shipments

The purchaser is responsible for determining and complying with import, transit and destination-country requirements applicable to transportation and importation carried out by or on behalf of the purchaser.

This may include, where applicable:

customs formalities;
import licences or permits;
customs duties and taxes;
Dangerous Goods requirements;
local transport restrictions; and
other import or transportation requirements.

CC Corrosion Control Ltd. will provide reasonable assistance and documentation required from the seller under applicable law.

9. Shipping Restrictions

CC Corrosion Control Ltd. supplies products exclusively to business customers.

Certain products may be subject to transportation restrictions depending on:

product classification;
mode of transport;
destination country;
carrier restrictions; or
applicable Dangerous Goods legislation.

Where CC Corrosion Control Ltd. becomes aware that a proposed collection or transportation arrangement does not meet applicable requirements, we reserve the right to withhold release of the goods until a compliant transportation arrangement has been provided.

10. Relationship with our Terms and Conditions

This Shipping and Delivery Policy forms part of and should be read together with the CC Corrosion Control Ltd. Terms and Conditions of Sale (B2B).

In the event of a conflict, the Terms and Conditions of Sale and any individually agreed written delivery terms applicable to the particular transaction shall take precedence.
